ON ROAD ELECTRIC

CONSTITUTION

1. Name:

The name of the Association shall be The South African Radio Drivers Association for On Road Electric’s, hereinafter referred to as SARDA.

2. Aims and Objectives:

To co-ordinate and administratively control all facets of Radio Control Electric On Road Model Car Racing in South Africa sanctioned by SARDA for the formats of 1/12th scale and 1/10th scale electric powered road going model cars and any future scale or format that it may associate itself with, at any venue of any affiliated club to itself.

To assist and encourage any new member in fostering the honest principles of this constitution and its racing by laws and for his progressive achievement in the sport on a provincial and National basis.

To protect the sport and its members from any harmful exploitation and/or dishonest promotion.

To protect the public, competitors and assistants from bodily injury or damage to property by participants of the sport or their vehicles during any event under the authority of SARDA.

To encourage and assist activities designed to foster good relations between the public and the sport.

To work with other Provincial and National Radio Control Model Car Associations towards International competition and to assist in any way possible the participation in these events by SARDA membership.

To affiliate itself with the Executive Governing body and therefore the National Sports Council and the International Governing Body for Model Car Racing, but not to harm the interests of the membership of SARDA within this constitution in so doing.

3. Status:

SARDA shall be a separate legal entity entirely distinct from other National governing bodies within the sport of Model Car Racing.

4. Membership:

Any person, regardless of gender, race, colour or creed, may be eligible for membership within SARDA providing on the following:

-The person is a fully paid up member of an official SARDA affiliated club or organisation, the person must provide proof of such membership.

-The person agrees to the Rules and Regulations as set out by SARDA.

-The person is not currently serving a disciplinary suspension or banning by SARDA or any National Governing body of the sport of Model Car Racing.

-The person agrees to the annual fees as set by SARDA.

5. Termination or Suspension of Membership:

SARDA reserves the right to terminate or suspend any of it’s registered members for the following reasons:

-The member is guilty of malpractice or convention of this constitution.

-The member has been disciplined by the protest committee of a National event and recommendation has been forwarded to SARDA for further action.

-Recommendation has been forwarded by another National Governing Body that the member is undesirable within the sport.

-The member’s act of conduct is such that it brings SARDA or the sport into disrepute.

All recommendations will be treated seriously and any proposal for action must be approved by the current SARDA committee by majority vote.

6. Indemnity:

SARDA or any affiliated club thereto shall in no way be liable for any Damage, Injuries or losses sustained by, or debt incurred, by it’s members due to negligence of the current committee or fellow members or any third party.

7. Finances:

-The committee shall hold a Bank account in the name of SARDA Electric’s at any chosen Financial institute through which all income and expenditure shall pass through.

-Such an account must have at least Two signature bearers one of which should be the current treasurer. It is also recommended that a third member of the current committee have Power of Attorney in the event of one of the signatories not being available.

-True and accurate books of account of the financial affairs of SARDA must be kept at all times.

-A annual audit of SARDA’s income and expenditure shall be available at the Annual General Meeting for approval.

8. Income:

Income shall be derived from affiliation fees, membership fees and one third of race entry fees from all SARDA sanctioned events.

SARDA will also pursue other means of income via any other legal and acceptable means.

9. The Committee:

The SARDA committee shall comprise of at least the following officials:

Chair person

Secretary

Treasurer

Public Relations Officer

Technical Advisor

At Least one General Member

The above committee shall be democratically elected at the Annual General   Meeting.

The committee, in it’s own capacity, may at any time elect further members to the board to fulfil duties required or vacated.

10. Voting Procedures:

For committee voting:

Any person who is nominated for election onto the committee must acknowledge his/her intent to serve on the committee and apart from his/her nomination, he/she must be seconded by at least one other member.

For general voting:

Voting at any meeting of SARDA shall be by show of hands or by secret ballot. The system applied shall be decided upon by the Chair person of that meeting. A member may vote ‘FOR’, ‘AGAINST’ or ‘ABSTAIN’ on any motion put forward for voting. Any motion that is put forward for voting must be seconded by another member apart from he/she who put forward the motion.

Quorum:

A Quorum at any meeting shall be the Chair person and 50% of the membership (or committee at a committee meeting).

Under no circumstances shall proxy votes be carried by any member present at the AGM.

11. Amendments:

This constitution may only be amended at the AGM provided that proposed amendments are accepted by at least two thirds of the delegates present and that such an amendment by circularised in detail to all the members at least six weeks in advance of the AGM date.

 

12. Racing Procedures and Bye-laws:

Applicable racing procedures and bye-laws must be drawn up by the committee and made available to all affiliated clubs and members.

These procedures and bye-laws must be derived from International standards as well as the best interest of the sport in South Africa.

They may be amended from time to time by the committee provided that all affiliated clubs are advised of this intention, otherwise such changes must be by majority vote at the AGM or a special rules meeting to which all members are invited.

All changes to the procedures and bye-laws will only take effect one month from the date of publication, unless by majority vote at an advertised rules meeting or the AGM.
